Heard learned counsel for the petitioner and learned Government Pleader for the respondents.
In spite of granting sufficient time to the respondents no counter affidavit is filed and, hence, the Writ Petition is being disposed of at the stage of admission.
It is the case of the petitioner that he had two daughters and one son. On 08.08.2014, one of his daughters left for her work place, but she did not return. In those circumstances, a complaint was lodged and the same was registered as Crime No.309 of 2014. The fourth respondent registered FIR No.317 of 2014 under section 174 Cr.P.C., on finding a dead body floating in Krishna River near Railway Bridge on 09.08.2014 by the V.R.O., Tadepalli. A panchanama was conducted and came to the tentative opinion that the deceased committed suicide. However, they could not identify the name of the deceased female. When no action was taken on his complaint, the petitioner approached the Superintendent of Police on 15.09.2014 by way of written representation.
In spite of registration of complaint and representation to the Superintendent of Police, when no action was taken, the present Writ Petition was filed. As stated above, learned Government Pleader took notice for respondents 3 and 4 on 07.11.2014 and did not file any counter. When this matter was listed before this Court on 31.01.2017, after taking one week's time also no instructions were received by the learned Government Pleader.
In the circumstances, the second respondent is directed to look into the record, verify the stage of investigation and issue necessary instructions to the concerned for completing the investigation within a period of three (3) months from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
