THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.17230 of 2017 ORDER :

The case of the petitioner is that he made an application dated 26-02-2015 for grant of Fair Price Shop Dealership on compassionate grounds on account of the death of his father, who worked as a Fair Price Shop Dealer in respect of Shop No.23 of Kuruparthi Village, Valmikipuram Mandal, Chittoor District, in terms of G.O.Ms.No.4, Consumer Affairs, Food and Civil Supplies (CS-I) Department, dated 28.02.2014. But without disposing of the same, now the respondentauthorities issued notification for appointment of permanent dealer for shop No.23, where the petitioner is running fairprice shop. Aggrieved by non-disposal of representation and issuance of notification for making appointments, the present writ petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Civil Supplies. Learned Government Pleader for Civil Supplies submits that on the basis of enquiry it is found that one of the brothers of the petitioner is working as sub-Post Master. As such, the petitioner is not entitled for being appointed as Fair-price shop dealer as per clause (vii) of para No.6 of G.O.Ms.No.4, dated 28-02-2014.

If the application is made by the petitioner and if he does not come under the purview of clause (vii) of para No.6

ARR,J W.P.No.17230 of 2017 of G.O.Ms.No.4, dated 28-02-2014, it is for the 3rd respondent to consider the aspect of his appointment and pass appropriate orders.

Without expressing any opinion on merits, the 3rd respondent is directed to dispose of the application of the petitioner for appointment as Fair Price Shop Dealer in terms of G.O.Ms.No.4, Consumer Affairs, Food and Civil Supplies (CS-I) Department, dated 28.02.2014 within a period of two weeks from the date of receipt of a copy of this order and communicate the same to him.

Accordingly, this writ petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
