HON'BLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.1133 of 2015 ORDER :
This revision is preferred by the petitioner challenging the order, dated 23.02.2015 in Crl.M.P.No.182 of 2015 in Cr.No.22 of 2015 passed by the learned III Additional Judicial First Class Magistrate, Warangal, whereby the learned Judge while allowing the petition for the interim custody of the jaggery and alum to the petitioner, imposed a condition that the petitioner shall execute a personal bond for Rs.2,00,000/- with one surety of like sum.
Learned counsel for the petitioner submitted that the possession of jaggery and alum is not an offence and the jaggery and alum are not liable for confiscation under Section 46 of A.P.Excise Act.
After considering the submission of the learned counsel, the order passed by the trial Court is modified and the trial Court is directed to return the property concerned to the petitioner on his executing a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only). The criminal revision case is disposed of.
Miscellaneous petitions, if any, pending in this revision shall stand closed.
