THE HONOURABLE SRI JUSTICE RAJA ELANGO TRANSFER CRIMINAL PETITION No.41 OF 2016 ORDER:

This Transfer Criminal Petition, under Section 407 of the Code of Criminal Procedure, 1973, is filed to withdraw C.C.No.634 of 2015 on the file of the XI Additional Chief Metropolitan Magistrate at Secunderabad, Telangana and transfer the same to the file of the V Additional Judicial Magistrate of First Class, Nellore, S.P.S.R. Nellore District, Andhra Pradesh.

2. The offence alleged against the petitioners is punishable under Section 500 read with 120-B I.P.C.

3. Heard and perused the material available on record.

4. After arguing for sometime, learned counsel for the petitioners while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioners before the trial Court and also prayed to recall the N.B.Ws issued against petitioner Nos.3 and 4/A-3 and A-4 by the trial Court and stated that the petitioners are ready to face the trial and they will not flee from the hands of justice.

5. Having heard the learned counsel for the petitioners and the learned Public Prosecutor and having perused the material available on record, this Criminal Petition is disposed of with the following directions:

Petitioner Nos.3 and 4/A-3 and A-4 are directed to approach the Court concerned and file a petition to recall the warrants issued against them and on such petition being filed, the Court concerned is directed to recall the warrants on the same day on their execution of a bond for a sum of Rs.5,000/- (Rupees five thousand only) each with

one surety for a like sum each. Further, the presence of the petitioners before the trial Court is dispensed with except on the dates on which the learned Magistrate insists for their appearance. The petitioners shall be properly represented through their counsel before the trial Court.

6. Miscellaneous Petitions pending, if any, in this Transfer Criminal Petition shall stand closed.
