THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.7604 of 2017 ORDER:

This criminal petition is filed by the petitioner-accused No.3, under Sections 437 and 439 Cr.P.C., seeking regular bail in S.C.No.97 of 2010 on the file of the Court of I Additional District and Sessions Judge, Vijayawada, arising out of Crime No.56 of 2010 on the file of the Station House Officer, Satyanarayanapuram Police Station, Vijayawada, Krishna District, registered for the offences punishable under Sections 302, 307, 364, 201, 427, 379, 120(B) read with 34 IPC.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor representing the State. 3.

The petitioner was arrested and remanded to judicial custody on 07.02.2010. Number of bail applications filed by the petitioner were dismissed by the Sessions Court and this Court.

Learned counsel for the petitioner submitted that the trial Court may take some more time for disposing of the matter, therefore, the petitioner may be enlarged on bail. Per contra, the learned Additional Public Prosecutor submitted that the petitioner has taken eleven months time for crossexamination of P.Ws.77 and 78. The learned Additional Public Prosecutor further submitted that the trial Court is

taking the matter on every Tuesday and Friday in the afternoon session, i.e., from 2.30 p.m. onwards. 5.

When the petitioner has taken eleven months time for cross-examining two witnesses, he cannot blame anybody for non-disposal of the matter except himself. In all probabilities the trial Court may dispose of the case within a short period. 6.

Taking into consideration the facts and circumstances of the case as well as the nature of offences alleged, this Court is of the considered view that it is not a fit case to grant bail to the petitioner-accused No.3 at this stage. 7.
