HON'BLE SRI JUSTICE R.KANTHA RAO W.P.No.25512 of 2015 ORDER:

This writ petition is filed seeking to declare the proceedings dated 20.04.2015 issued by the 4th respondent, as arbitrary, illegal and to direct the 4th respondent to reinstate the petitioner into service. Learned counsel appearing for the petitioner submits that the suspension order was passed on false and trivial charges and without affording opportunity to the petitioner to submit his version. He further submits that the workers from whom the petitioner allegedly collected Rs.10/-, gave statement in favour of the petitioner that he never collected any such amount from them.

In any event these facts have to be established by evidence which can be let in by either of the parties in the course of enquiry by the authority concerned and this Court is not supposed to evaluate the evidence.

Accordingly, the Writ Petition is disposed of directing the 4th respondent to complete the enquiry and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order failing which the order of suspension shall

stand revoked. There shall be no order as to costs.

Miscellaneous petitions pending, if any, shall stand closed.
