THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.10210 and 10261 of 2017 COMMON ORDER:
These Writ Petitions are filed challenging inclusion of the names of the petitioners in FIR No.46 of 2017 though they were not connected with the offence.
A reading of the FIR shows that the petitioners were shown as accused. Since FIR No.46 of 2017 was registered by the Police on the basis of the complaint and on reference made by the Court, this Court is not inclined to entertain the present Writ Petitions.
However, the Writ Petitions are disposed of directing the third respondent to follow due process of law while investigating the crime, including compliance with Section 41-A of the Code of Criminal Procedure. The miscellaneous petitions pending in these Writ Petitions, if any, shall stand closed. There shall be no order as to costs.
