HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.833 OF 2017 O R D E R :

This writ petition is filed challenging the proceedings dated 27.03.2017 issued by the 3rd respondent whereby petitioner's fair price shop authorisation for Shop No.19 of Kannamadakala Village of Orvakal Mandal is suspended pending enquiry.

Learned counsel for the petitioner submits that petitioner was issued show cause notice dated 14.03.2017 and after filing explanation by the petitioner, the impugned order is passed; and that as on today, no final orders are passed by conducting enquiry, but the order of suspension is being continued.

Heard learned Assistant Government Pleader for Civil Supplies.

This court in D.Sambasiva Rao v. Joint Collector, Guntur and others (2007 (6) ALT 239) has taken a view that suspension of fair price shop authorization pending enquiry, cannot normally be continued beyond a period of ninety days.

In view of the same, the impugned order vide Rc.B.281/2017, dated 27.03.2017, issued by the 3rd respondent suspending the petitioner's authorization, is set

aside. However, this order will not preclude the respondent authorities from passing final orders after affording opportunity of hearing to the petitioner Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 05.01.2018 t k.
