HON'BLE SMT.JUSTICE T.RAJANI CRIMINAL PETITION No.8438 of 2017 ORDER:

This criminal petition is filed under Section 482 of the Code of Criminal Procedure, 1973, seeking to quash the proceedings in Cr.No.93 of 2017 on the file of P.S., Karankote, Vikarabad District. Heard the learned counsel for the petitioner and the learned Public Prosecutor for the 1st respondent and with their consent, the Criminal Petition is being disposed of at the stage of admission. Considering the delay in giving report, it is felt fit to order the Police to follow the guidelines laid down by the Supreme Court in Arnesh Kumar v. State of Bihar1 and not to arrest the petitioner without such compliance. After due investigation, if the petitioners are still aggrieved, they can move similar petition at the appropriate time.
