- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.5437 OF 2013 ORDER:

This Writ Petition is filed praying to grant the following relief: "For the reasons stated in the affidavit, accompanying this Writ Petition, it is prayed that this Hon'ble Court may be pleased to issue a writ or order or direction, especially one in the nature of Writ of Mandamus:

i) declaring the action of the 2nd respondent in not permitting the petitioner to perform duties as conductor on contract basis, consequent to issuance of Charge Sheet No.E2/101(4)/2012-HNK dated 19.11.2012 as illegal and arbitrary.

ii) consequently direct the 2nd respondent to permit the petitioner to perform her duties as conductor (contract). iii) and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

This Court, by order dated 08.03.2013, granted interim direction, as prayed for. The interim prayer sought was to direct the 2nd respondent to permit the petitioner to perform her duties as Conductor.

When the matter is taken up, learned standing counsel for the respondent - Corporation informs that pursuant to the charge memo dated 19.11.2012, disciplinary proceedings were concluded and by order, dated 15.05.2013, the petitioner was removed from service.

In view of the same, the cause in the Writ Petition does not survive for adjudication and the Writ Petition is accordingly
