THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.309 OF 2024 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime.No.1025 of 2023 on the file of Raidurgam Police Station, Cyberabad, registered for the offences under Sections 376 (2) (n) 384, 417 & 420 of IPC. 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the Raidurgam Police is that the de-facto complainant lodged a complaint alleging that this petitioner got acquainted with her through a marriage bureau. On 12.08.2023, the petitioner proposed her and on 14.08.2023, he took her for outing and had sexual intercourse. Thereafter also they had sexual intercourse several times. Further, the petitioner took an amount of Rs.2,50,000/- from her. However, he postponed the marriage and refused to marry her.

It appears that the case has been registered after proposal of marriage in between the petitioner and the de-facto complainant did not go as planned.

Since major part of the investigation is complete, the petitioner can be granted the relief of regular bail, subject to following conditions:- i) The petitioner/Accused shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties, for a like sum each to the satisfaction of the XIII Additional Metropolitan Magistrate, Cyberabad at Rajendranagar.

ii) The petitioner/Accused after release shall appear before concerned Station House Officer at 10:00 a.m. on every Monday for a period four weeks for the purpose of investigation and thereafter, as and when required. iii) The petitioner/Accused shall not in any manner try to contact or go near the de-facto complainant. Failing which, the Police are entitled to seek cancellation of bail granted.

iv) The petitioner/Accused shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 6.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed. __________________ K.SURENDER, J Date : 24.01.2024 dv
