This writ petition is filed to declare the action of the 1st respondent in permitting the 4th respondent to install rice mill in the land admeasuring Ac.2-36 guntas in Sy.No.353 and 354 of Ponakal Village, Jannaram Mandal, Adilabad District, pursuant to the permission granted in GPP/116/2011, dated 09-07-2011 as illegal and arbitrary.

Counter is filed by the 1st respondent stating that the 3rd respondent i.e. District Town and Country Planning Officer, Adilabad vide proceedings dated 18-06-2011 had directed the 1st respondent to release the approval plans of rice mill after obtaining 'No Objection Certificates' from the concerned authorities. Accordingly, letters have been submitted to the A.P.Polution Control Board, Fire and Emergency Department and Department of Factories. Therefore, permission, dated 09-07-2011, issued by the 1st respondent for construction of rice mill is not illegal and arbitrary. No reply affidavit is filed by the petitioner. Even otherwise, the petitioner has not challenged the permission granted to the 4th respondent.

In view of the same, I do not see any merit in the writ petition. Accordingly, the Writ Petition is dismissed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
