HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.36091 of 2015 ORDER:
The petitioner claims to be in possession of the land admeasuring Ac.1-00 cents in R.S.No.161/1 situated at Kodurupadu Village, Bapulapadu Mandal, Krishna District. The petitioner claims that his father Jami Suryanarayana was granted D-form patta for the aforesaid land. Since the said assignee died on 17-11-2010, the petitioner succeeded and continues to be in possession and enjoyment of the subject land. He states that his name was included in the revenue record as enjoyer of the aforesaid land, but his name is deleted by the 3rd respondent, whereupon the petitioner made representations dated 06-09-2014 and 04-08-2015 requesting the 3rd respondent to restore his name. Alleging inaction on the part of the 3rd respondent, the present writ petition is filed.
Learned Government Pleader submits that even as per the documents filed by the petitioner, the nature of the land is recorded as Government land and the petitioner is shown only as enjoyer.
Irrespective of the fact whether the petitioner is shown as enjoyer in the revenue record, the request of the petitioner made in his representation is required to be considered by the 3rd respondent.
Hence, the writ petition is disposed of directing the 3rd respondent to consider the representations of the petitioner, as aforesaid, and after appropriate enquiry, pass appropriate orders expeditiously, preferably within four weeks from the date of receipt of a copy of this order. No costs.
Miscellaneous petitions, if any, pending shall stand closed.
