THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY & THE HON'BLE SRI JUSTICE M.S.K.JAISWAL FCA MP No.143/2016 in FCA No.263/2015 & FCA No.263 of 2015 JUDGMENT: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) FCA No.263 of 2015 is filed against the order, dated 12.06.2015, in O.P.No.166 of 2011, on the file of the Judge, Family Court, Ranga Reddy District at L.B.Nagar, Hyderabad, whereby the Court below has declined to grant decree for dissolution of marriage between the appellant and the respondent. The learned counsel for both parties have filed FCA MP No.143 of 2016 for recording compromise and allowing the appeal. Along with the memo, they have filed memorandum of terms of compromise, signed by both parties and also the affidavits filed by them. They have also filed Lok Adalat Award, dated 29.12.2015 in O.S.No.
418 of 2012, whereunder a compromise decree was passed between the son of the appellant and the latter. Both parties are personally present in the Court today and they have stated that out of their free will and consent, they have entered into compromise, as per which, they have agreed for dissolution of their marriage. The respondent has requested the Court to allow the appeal filed by her husband and grant decree of dissolution of marriage.
In the light of the above facts, FCA MP No.143 of 2016 is ordered and compromise is recorded. Consequently, FCA No.263
of 2015 is allowed and O.P.No.166 of 2011 is decreed, in terms of memorandum of compromise, dated 14.03.2016.
