THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.39878 OF 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The petitioner, who claims to be the owner of Acs.2.30 cents of land in Survey No.129/2 of Marripalli Village, Salur Mandal, Vizianagaram District, is aggrieved by the action of the Sub-Registrar, Salur, Vizianagaram District, the 3rd respondent, in not receiving and registering the sale deed presented by him on the ground that the said land is included in the prohibitory list. Therefore, the petitioner made a representation to the Tahsildar, Salur Mandal, Vizianagaram District, the 4th respondent, and under proceedings in Rc.No.572/2015 SA, dated 06.10.2015, the 4th respondent sent a detailed report to the District Collector, Vizianagaram District, the 2nd respondent, recommending deletion of the said lands from the prohibitory list by clarifying that Survey No.129 is sub-divided into Survey No.129/1 admeasuring Ac.0.

86 cents classified as River and Survey No.129/2 admeasuring Acs.2.82 cents classified as zeroyathi dry, which is under occupation of the petitioner. It is further stated that due to erroneous entry in Government Lands Register, the 4th respondent recommended for deletion of Survey No.129 from the prohibitory list and as long as the land continues in the prohibitory list, the 3rd respondent cannot entertain any document for registration.

appropriate decision and communicate the same to the petitioner as well as to respondents 3 and 4 expeditiously, preferably within a period of six weeks from the date of receipt of a copy of this order. The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
