Respondent No.

2 /complainant is the wife of A.1. As per Court Order dated 16.04.2013, case against petitioner No.4/A.5 was dismissed as not pressed. 3 a) Originally, 2nd respondent lodged FIR No.153 of 2010 in Sullurpeta P.S for the offence under Sec.498A IPC and Sec.3 & 4 of D.P Act against A.1 to A.7. The Police after investigation however filed chargesheet against A.1 alone omitting A.2 to A.7 including the present petitioners on the ground that there was no evidence from independent witnesses about the harassment allegedly meted out by A.2 to A.7. Learned J.F.C.M., Sullurpeta, took cognizance of the charge-sheet and registered as C.C.No.23 of 2013. b) While-so, the defacto complainant filed a protest complaint aggrieved by the omission of A.2 to A.7. The trial Court conducted enquiry and recorded the evidence of LWs.

1 to 5 and took cognizance of the matter against A.1 for the offence under Sec.420 IPC and against A.2 to A.4 for the offence under Sec.498A and 420 IPC. Hence the instant petition. 4) Heard both sides. 5) The main plank of argument of the petitioners/A.2 to A.4 is that the protest complaint and evidence recorded by the learned Magistrate do not disclose any offence against the petitioners and learned Magistrate without application of judicial mind has taken cognizance against the petitioners and issued summons. Their further submission is that even if the petition averments are uncontroverted, no offence whatsoever took place at Sullurpeta and hence the Court of Judicial First Class Magistrate, Sullurpeta has no territorial jurisdiction to try the case. Learned counsel relied upon the decision reported in Pepsi Foods Ltd.

And another vs. Special Judicial Magistrate and others​ on the aspect that before issuing summons under Sec.204 Cr.P.C, the Magistrate shall apply his mind to the facts of the case and law applicable thereto. 6) In oppugnation, learned counsel for complainant argued that A.1, who is the husband of defacto complainant is an impotent due to which, the marriage between him and complainant could not be consummated and all the accused performed the marriage by suppressing this fact and therefore, they are liable for the charge under Sec.420 IPC.

Learned counsel further argued that immediately after marriage when the complainant went to the matrimonial home, the accused have taken away entire 50 Sovereigns of gold and 1 1⁄2 kgs of Silver from the complainant and they did not provide food and neglected her and therefore, their acts attract the offence under Sec.498A IPC also. Due to all these background facts, the trial Court rightly took cognizance of the offences under Sec.420 and 498A IPC against petitioners and therefore, petition merits dismissal. 7) In the light of above rival arguments, the point for determination is: "Whether there are merits in this petition to allow?" 8) POINT: On a careful scrutiny of the protest petition and evidence recorded by the trial Court, I am of the considered view that there is no incriminating material against petitioner/A.4-M.

Pallavi, who is the married sister of A.1. The allegation against her is that she along with other accused suppressed the impotency of A.1 and performed his marriage with the complainant and further, when the complainant joined matrimonial home, she along with other accused took away 50 Sovereigns of Gold and 11⁄2 kgs of Silver from the complainant and she did not provide food to the complainant and neglected. In my view, all these allegations are general in nature to rope in the married sister also. When the protest petition and evidence are perused, we can cull out that at the time of marriage, A1 and his parents demanded Rs.5,00,000/- of cash and 50 sovereigns of gold towards dowry and also demanded Rs.

2,00,000/- for the purpose of household articles but the father of the complainant could give only 50 sovereigns of gold and 1 1⁄2 kgs of Silver and he failed to pay Rs.5,00,000/- of cash. This narration would show as if the marriage talks were held between either parents of the complainant and A1 and there is no specific allegation to the effect that petitioner/A.4 also participated in the negotiations and made any demand. The father of A.1 is said to be working as Medical Officer in Hosuru in Tamil Nadu. As such the factum of the alleged impotency of A.1 could at best be known to his parents rather than his married sister, so the probability of concealing this fact lies more with the parents of A.1 i.e, petitioners/A.2 and A.3 rather than petitioner/A.4. Therefore, it is inappropriate to allege that she too concealed the impotency of A.

As per the submission of the petitioners, the little daughter of petitioner/A.4 aged about 3 years was suffering with leukemia and she was hospitalized on 26.05.2010 i.e, since few days prior to the date of marriage i.e, 04.06.2010 and therefore, immediately after marriage all the family members left to Bangalore. In these circumstances, it is difficult to conceive that petitioner/A.4 will show any interest in the affairs of her newly married brother and sister-in-law and particularly in harassing her. a) Sofaras forcible taking of gold and silver from the complainant is concerned, in her evidence the complainant stated that when her parents asked the petioners/A.2 and A.3 to return the gold and silver, they replied that the properties were in the locker of petitioner/A.4.

Except that the complainant did not state in her evidence that the accused particularly the petitioner/A.4 forcibly took the gold and silver and kept in her locker. 9) So at the outset, the trial Court's order in taking cognizance of the offences under Sec.498A and 420 IPC against petitioner/A.4 cannot be countenanced and therefore, the proceedings are liable to be quashed sofaras petitioner/A.4 is concerned. 10) Petitioners argued as if no part of the offence whatsoever took place at Sullurpeta and so the J.F.C.M., Sullurpeta, has no jurisdiction to try the offence. This argument cannot be accepted for the reason that as per the protest petition, the marriage between complainant and A.1 was performed on 04.06.2010 at TVRR Kalyana Mandapam, Sullurpeta as per caste customs.

The place of marriage generally will have no importance in conferring the jurisdiction in an offence under Sec.498A IPC. However, the allegations are that the accused have concealed A.1's impotency and performed the marriage and thus cheated complainant and her parents. If this fact is uncontroverted, performance of the marriage at Sullurpeta by concealing a material fact will amount to an offence under Section 420 IPC which occurred within the jurisdiction of the trial Court. Therefore, the petitioners argument regarding lack of territorial jurisdiction cannot be accepted. 11) In the result, this Criminal Petition is partly allowed and proceedings in C.C.No.23 of 2013 on the file of Judicial Magistrate of First Class, Sullurpeta are quashed against petitioner/A.4Mallavaram Pallavi only.

As a sequel, miscellaneous applications pending, if any, shall stand closed. __________________________ U.
