THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL REVISION CASE No.3256 of 2016 ORDER:

This criminal revision case is filed under Sections 397 and Cr.PC challenging the order dated 06.12.2016 in Crl.M.P.No.1456 of 2016 in C.C. No.886 of 2015 on the file of the Court of IV Additional Judicial First Class Magistrate, Warangal. 2.

When the matter is called for hearing, learned counsel for the petitioners has sought permission of this court to permit the petitioners to withdraw the criminal revision case, with liberty to the petitioners to file petition under Section 70(2) Cr.P.C., before the trial court. She further submitted that the trial court may be directed to dispose of the petition on the same day of its filing. 3.

Accordingly, the criminal petition is dismissed as withdrawn granting liberty as prayed for. The petitioners are permitted to appear before the trial Court and file application under Section 70(2) of Cr.P.C., seeking to recall the non-bailable warrants issued against them. On such application is being filed, the trial court is hereby directed to consider and dispose of the same, on the same day, in accordance with law.
