THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE Mr. JUSTICE M. GANGA RAO Writ Appeal No.26 of 2018 Judgment: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) This appeal, under Clause 15 of the Letters Patent, is preferred against the order of the learned Single Judge in W.P. No.1344 of 2015 dated 27.11.2017. The appellant herein is the petitioner in the Writ Petition. She is aggrieved by the order of the learned Single Judge dismissing her Writ Petition making several observations on merits.
Sri Sitaram Chaparla, learned counsel for the appellant, would submit that the Writ Petition was filed questioning the action of the Revenue Divisional Officer in issuing notice for dispossession; and, as the matter is still pending consideration before the Revenue Divisional Officer, the learned Single Judge had erred in adjudicating the petitioner's entitlement, to retain possession of the subject land, on merits. Sri K. Purushotham, learned counsel for the 6th respondent, would submit that the appeal preferred by the 6th respondent against the entries made in the record of rights, and in issuing pattadar passbooks and title deeds to the appellant-writ petitioner, has been subjected to challenge; and the matter is still pending before the Revenue Divisional Officer.
Learned counsel on either side agree that, instead of examining the order under appeal on its merits, it would suffice if the said order is set aside and the Revenue Divisional Officer is directed to dispose of the proceedings, and the appeal pending before him, within a specified time frame.
with utmost expedition and, in any event, not later than three (3) months from the date of receipt of a copy of this order. The Writ Appeal stands disposed of accordingly. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
