THE HON'BLE SRI JUSTICE T. VINOD KUMAR Writ Petition No.740 of 2020 ORDER:

The present writ petition is filed to declare the action of the 3rd respondent-Station House Officer, Ghanpur (Women) Police Station, Warangal District, in not completing the investigation and not filing the final report before the competent Court in connection with the FIR No.200 of 2017, dated 23.09.2017, as being illegal and arbitrary. Heard Sri M. Ajay Kumar, learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for the respondents.

The learned Assistant Government Pleader for Home, on written instructions dated 20.01.2020, which is placed on the record of this Court, would submit that based on the complaint of the petitioner, a case was registered in Crime No.200 of 2017 on 23.09.2017 and the matter was investigated into. It is submitted that during the course of investigation, LWs.1 to 6 were examined and their statements were recorded. As per the investigation done, it disclosed that the complainant with a malicious intention has given the complaint against the accused persons as a counter blast to the case registered against him in Crime No.199 of 2017. The learned Assistant Government Pleader for Home on the basis of written instructions would further submit that

after completion of the investigation, the 3rd respondent authority after obtaining permission from the Assistant Commissioner of Police, Station Ghanpur Division, vide proceedings in C.No.45/ACP-Stn/GNPD/2019, dated 31.03.2019, referred the case as "False". It is also submitted that after serving notice to the petitioner on 10.01.2020, a final report was filed before the VII Additional Judicial First Class Magistrate, Warangal on 20.01.2020.

Since a final report is filed with regard to the investigation done into the crime based on the complaint of the petitioner, after serving notice to the petitioner, no further orders need be passed in this writ petition, except observing that it is open for the petitioner to approach the appropriate forum to avail remedies in accordance with law, if the petitioner is aggrieved thereby.

Subject to the above observation, the writ petition is closed. However, there shall be no order as to costs. As a sequel thereto, Miscellaneous Applications, if any, pending in this Writ Petition shall stand closed. ___________________ T. VINOD KUMAR, J Date: 28.01.2020 Isn
