Smt. Y. Vijaya Lakshmi, Hyderabad v. The District Vocational Education Officer, Hyderabad And3 Ots
THE HON'BLE SRI JUSTICE M.GANGA RAO WRIT PETITION No.11129 OF 2005 ORDER:
The petitioner, who is a Junior Lecturer in Chemistry, filed this writ petition aggrieved by the proceedings dated 26.04.2005 of the 1st respondent, whereby the petitioner was transferred from the 3rd respondent-College to the 4th respondent-College, as being illegal and arbitrary. 2.
The brief facts of the case are that the petitioner was appointed as a Junior Lecturer in Chemistry in the 3rd respondent-College. The petitioner states that the 3rd respondent-College is a minority institution being run and maintained by Karnataka Shikshana Samity and the 1st respondent has no power or jurisdiction to transfer the petitioner from the 3rd respondent-College to the 4th respondent-College. She further states that if she is transferred, she will be deprived of her seniority as the 3rd respondent-College, being a minority institution, it has its own service regulations and she is the seniormost Lecturer in Chemistry in that college.
3.
This Court, on 10.05.2005, passed interim order directing the respondents not to relieve the petitioner, and thereafter, the said order was made absolute on 14.09.2007.
4.
Now, it appears that the petitioner reached the age of superannuation as she is aged about 52 years as on the date of filing of the writ petition. This Court felt that no cause survives in this writ petition for adjudication . 5.
Accordingly, the Writ Petition is dismissed as infructuous. No order as to costs.
6.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand dismissed.
