THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.328 OF 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to declare the action of the respondents in not allowing the petitioner to participate in "Vikunta Ekadasi Day" celebrations as founder of respondent No.4 temple as illegal, arbitrary and contrary to the provisions of the Telangana Charitable and Hindu Religious Institutions and Endowments Act, 1987 (Telangana Adaptation Order 2014) and consequently, direct the respondents to allow the petitioner to participate in the "Vikunta Ekadasi Day" celebrations on 8.1.2017 in the respondent No.4 temple as founder.

Case of the petitioner is that the respondents have already recognised him as founder of respondent No.4 temple, but there are no orders to that effect from the Endowment Department in the 43 register; that he is not allowed to participate in "Vikunta Ekadasi" day celebrations to be held on 8.1.2017; that as an abundant caution, he filed O.A.(SR)No.6128 of 2016 before the Tribunal for the purpose of recognizing him as founder of respondent No.4 temple and the office returned the same on the ground of maintainability and he represented the same before the Tribunal and hence, prays to allow him to participate in the "Vikunta Ekadasi Day" celebrations in respondent No.4 temple on 8.1.2017.

Heard and perused the material available on record.

Considering the facts and circumstances of the case and the grievance of the petitioner, the petitioner is permitted to participate in the "Vikunta Ekadasi Day" Celebrations on 8.1.2017 and perform pooja in consultation with the Executive Officer of the said temple. Further, the petitioner is directed to seek further remedy in the aforesaid Original Application filed by him. 5.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
