Heard.

This Civil Revision Petition is filed aggrieved by the order dated 26.07.2011 passed in E.P.No.92 of 2010 in O.S.No.112 of 2006 on the file of the Principal Junior Civil Judge, Kavali. 3.

This Court, by order dated 14.10.2011, while issuing notice in the revision returnable within two weeks and directing list of the revision after two weeks, granted stay of the order in E.P. in the meanwhile subject to condition of the petitioner depositing half of the decretal amount including interest and costs within four weeks.

Learned counsel for the petitioner states that pursuant to the said order, the amount, as directed by the Court, was already deposited.

As seen from the order of this Court dated 14.10.2011, stay was operative for a limited period that too subject to condition of payment of amount.

Having regard to the peculiar facts of this case and since the decree was made long ago, the Civil Revision Petition is disposed of, without entering into the merits and contentions, directing the petitioner to pay the balance amount along with interest payable till realization of the amount, if not already paid, to be paid within a period of three weeks from the date of receipt of a copy of this order. Failing to pay the amount, as directed above, the order

dated 26.07.2011 passed in E.P.No.92 of 2010 shall revive. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Civil Revision Petition shall stand closed.
