THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.5169 of 2017 ORDER:

This petition is filed under Section 482 Cr.P.C. to quash the docket order dated 02.01.2017 in C.C.No.1063 of 2016 on the file of the Court of the I Additional Chief Metropolitan Magistrate, Visakhapatnam, presently transferred and renumbered as C.C.No.315 of 2017 on the file of the Court of the III Special Magistrate, Visakhapatnam.

A perusal of the record reveals that the petitioner herein is facing trial in C.C.No.1063 of 2016 for the offence punishable under Section 138 of the Negotiable Instruments Act. On 02.01.2017 the trial Court directed the petitioner to execute a bond for Rs.10,000/- with two sureties for the like sum each by the next date of adjournment i.e., on 13.02.2017.

At the time of arguments, the only relief sought by the learned counsel for the petitioner is to modify the impugned order to the extent of 'one surety' instead of 'two sureties'. 4.

Having regard to the facts and circumstances of the case, the docket order dated 02.01.2017 in C.C.No.1063 of 2016 on the file of the Court of the I Additional Chief Metropolitan Magistrate, Visakhapatnam, presently transferred and renumbered as C.C.No.315 of 2017 on the file of the Court of the III Special Magistrate, Visakhapatnam, is modified as follows: "The petitioner is directed to execute a bond for Rs.10,000/- with one surety for the like sum".

With the above direction, the Criminal Petition is disposed of. 6.

Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
