HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.29338 OF 2017 ORDER:

This writ petition is filed challenging the land acquisition Notification dated 21.12.2016 and the consequential publication of declaration dated 20.07.2017.

Learned counsel for the petitioner submits that the objections filed by the petitioner under Section 15(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act 30 of 2013, for brevity) are not considered properly by the Authorities. This Court, by an order dated 30.08.2017, in a batch of writ petitions, i.e., W.P.No.7016 of 2017 and batch, which are identical to the present writ petition, partly allowed the writ petitions setting aside the declarations published under Section 19(1) of Act 30 of 2013 and giving liberty to the petitioners to raise objections under Section 15(2) of Act 30 of 2013. In view of the same, this writ petition is also partly allowed setting aside the declaration dated 20.07.2017.

The petitioner is given liberty to file comprehensive written objections either individually or for the entire village in accordance with Section 15(2) of Act 30 of 2013, within two weeks from the date of receipt of a copy of this order and the Collector shall consider the said objections and deal with said objections thoroughly and pass a reasoned order considering the objections raised by the petitioner within a period of four weeks thereafter. It is needless to observe that at the time of considering the objections, the objectors shall be heard either in person or through their counsel.

Consequently, miscellaneous petitions, if any, pending in these writ petitions shall stand closed. There shall be no order as to costs. __________________________ A.RAMALINGESWARA RAO, J 31.08.2017 pln
