HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.785 of 2019 ORDER:

The prayer of the petitioner is this case reads as under: "That this Honourable Court may be pleased to issue a writ in the nature of a writ of Mandamus or any other appropriate writ, direction, order or orders declaring the action of the 2nd respondent in not issuing the e-pass book and title deed vide representation dt 08.11.2018 in respect of the petitioner's agricultural dry lands in an extent of Acs.2-02 gts in Sy.No.123 and an extent of Acs.2-28 guntas in Sy.No.142 in patta No.

229 situated at Mansanpalli village field, Maheshwaram Mandal, Ranga Reddy District, as wholly arbitrary, illegal and without jurisdiction and void and violative of the principles of natural justice and affected the petitioner's rights guaranteed under Articles-14, 19(1)(g) and 300(A) of the Constitution of India and consequently direct the 2nd respondent herein to issue e-pass book and title deed in her favour with reference to the agricultural lands in an extent of Acs.2-02 gts in Sy.No.123 and an extent of Acs.2-28 guntas in Sy.No.142 in patta No.229 situated at Mansanpalli village field, Maheshwaram Mandal, Ranga Reddy District, and pass such other order or orders as this Honourable Court may deem fit and proper in the interest of justice."

The record reflects that a pattadar passbook and title deed were issued to the petitioner under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 1971, in relation to the lands in Survey Nos.123 and 142 of Mansanpalli Village, Maheshwaram Mandal, Ranga Reddy District, admeasuring in all Acs.5.00 guntas. That being so, the revenue authorities would have to consider the petitioner's representation dated 08.11.2018 for issuance of an e-patta passbook.

The Writ Petition is accordingly disposed of directing the Tahsildar, Maheshwaram Mandal, Ranga Reddy District, to consider the petitioner's representation dated 08.11.2018 for issuance of an e-patta passbook on its own merits and in accordance with law. In the event, the Tahsildar, Maheshwaram Mandal, finds any ground to

refuse the request of the petitioner, he shall pass a reasoned order and communicate the same to her. This exercise shall be completed, one way or the other, expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.
