THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION No.2618 OF 2017 ORDER:
This civil revision petition, under Section 22 of the Andhra Pradesh Buildings (Lease, Rent and Eviction) Control Act, 1960, is filed by the appellant in R.A.No.52 of 2015 challenging the order dated 17.04.2017 in R.A. No.52 of 2015 passed by the Additional Chief Judge, City Small Causes Court, Hyderabad. The revision petitioner filed an undertaking affidavit that she would vacate the premises within one year on the ground that she is an old woman.
During hearing, Sri R.Umender Kumar, learned counsel for the respondent, contended that the building in dispute is notified by GHMC and ordered for demolition that it is in dilapidated condition and it is required to be removed in pursuance of the notice issued by the Municipal Corporation and if any untoward incident occurred, it is only at the peril of the petitioner. However, the Municipal Corporation granted one year time. Considering the undertaking affidavit filed by the petitioner, I deem it appropriate to grant six months time to vacate the premises subject to payment of rent continue for a period of six months and arrears of rent within one month from this date. In the event of failure to pay rent for a period of two months consecutively, the order stands vacated and the landlord/ respondent herein is entitled to evict the petitioner following the procedure i.e., executing the order contemplated as per the Act and Rules.
