Heard both sides. With the consent of both parties the writ petition is disposed of at the admission stage. 2.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.3 in not investigating into Crime No.287 of 2016 of Manakondur Police Station, Karimnagar, dated 22.12.2016 and issuing notice to appear before him with regard to filing of Crime No.10 of 2017 at the instance of respondent No.4, as illegal and arbitrary.

Though various grounds are raised, learned counsel for the petitioner mainly submits that insofar as Crime No.287 of 2016 of Manakondur Police Station, Karimnagar, is concerned, the police are not investigating the case and on the other hand, they are calling the petitioner to the police station in Crime No.10 of 2017, which was registered against him, at the instance of respondent No.4. 4.

Learned Government Pleader for Home, on instructions, would submit that the allegations made in the report are false and that the police are investigating both the crimes.

Having regard to the above statements made across the Bar, the writ petition is disposed of directing the respondent-police not to illegally summon the petitioner to the police station and if they intend to take any action in Crime No.10 of 2017, the same shall only be in accordance with law. Insofar as investigation in Crime No.287

of 2016 is concerned, it is to be noted that the said crime was registered in the month of December, 2016, as such the respondent police shall file a final report in Crime No.287 of 2016, as early as possible, in accordance with law. No costs. Consequently, miscellaneous petitions, if any pending, shall stand closed.
