Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Civil Supplies.

This writ petition is filed seeking a writ of Mandamus declaring the action of the respondents in not disposing the petitioner's representations dated 18.10.2014 and 14.11.2014 in terms of G.O.Ms.No.4 dated 28.02.2014 issued by the Government of A.P. (Appointment of Legal Heirs of the deceased F.P. Shop Dealers on compassionate grounds), as illegal and arbitrary.

3. The petitioner's husband Sri A.Raghavendra was appointed as F.P. Shop dealer for Shop No.17 of Uravakonda village and Mandal of Anantapur District by the 2nd respondent, after following due procedure. While he was discharging duties as F.P. shop dealer for some time, suddenly he died on 14.08.2014 due to viral fever. The petitioner is the wife of the deceased Raghavendra. It is submitted by the petitioner that the entire family was depending on the income of the deceased Raghavendra derived from the F.P. shop which he was running. After demise of the said Raghavendra, the family lost its source of livelihood and the present writ petition is filed to appoint the petitioner as F.P. shop dealer on compassionate grounds in terms of G.O.Ms.No.4, Consumer Affairs, Food and Civil Supplies (CS-I) Department dated 28.02.

In this connection, it requires to be noticed that the Government after taking into consideration the practice of compassionate appointment in relation to the legal heirs of the F.P. shop dealers in the other States and basing on the recommendations made by the Committee appointed by the Government, G.O.Ms.No.

dated 28.02.2014 was issued deciding to appoint the legal heirs of the deceased F.P. shop dealers as F.P. shop dealers on compassionate grounds, prescribing certain guidelines.

Therefore, the writ petition is disposed of at the stage of admission, directing the respondents to consider the case of the petitioner for appointment as F.P. shop dealer for Shop No.17 of Uravakonda Village & Mandal, Anantapur District, as per the guidelines issued by the Government in G.O.Ms.No.4, Consumer Affairs, Food and Civil Supplies (CS-I) Department dated 28.02.2014, within a period of two (2) months.
