THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.744 of 2018 ORDER:

The petitioner claims to be the son of deceased G.Narendar, who expired while working as Superintendent, Juriyal Project, Executive Division-2, Nandimalla Village of Amarchinta Mandal, Vanaparthy District on 22.10.2016. Respondent No.3 is stated to be second wife of the deceased, whereas respondents 4 and 5 are sons born through her. Respondent No.6 is mother, respondent No.7 is sister and respondent No.8 is grand-mother of the petitioner.

It appears that the second respondent issued a legal heir certificate pursuant to the application made by respondents 3 to 5 and in the said legal heir certificate, the names of respondents 3 to 7 and the petitioner were indicated. The present Writ Petition is filed challenging inclusion of names of respondents 3 to 5 on the ground that they have no right to be included as legal heirs of deceased G.Narendar, who is father of the petitioner. 3.

The legal heir certificate is issued on the basis of local enquiry and it does not give any right for the parties and it merely indicates the nature of relationship of the deceased with the parties mentioned therein, based on the local enquiry made by the Tahsildar. If the petitioner or any other party is aggrieved or claims any exclusive right, it is open to them to workout their remedies in accordance with law in appropriate Forum, but this Court cannot set aside the legal heir certificate, which was issued based on the enquiry.

The Writ Petition is, accordingly, disposed of giving liberty to the petitioner to workout his remedy in appropriate Forum.
