HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.9718 of 2009 ORDER :

Through representations dated 28.11.2008 and 29.11.2008, the petitioners requested for consideration and appointment of petitioners as authorized fair price shop dealers. The Writ prayer is against inaction in considering and disposing of the above representations, as illegal and unconstitutional.

Perused the material available on record and neither the petitioner nor the Assistant Government Pleader is in a position to place before the Court the latest position on the representations made by the petitioners. This Court is not inclined to consider the grievance of inaction at this point of time. The writ petition is dismissed. However, the petitioners are given liberty to avail the remedy against the final order, if any, passed by 1st respondent on the representations referred to above.

With the above observation, the writ petition is dismissed. No order as to costs.

As a sequel, pending miscellaneous applications, if any, shall stand closed.
