THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CRIMINAL APPEAL No.1072 OF 2007 JUDGMENT:

Aggrieved by the judgment dated 03.05.2007 passed in Crl.A.No.87 of 2003 on the file of the Court of the IV Additional District & Sessions Judge, Visakhapatnam, setting aside the conviction and sentence imposed against the accused in C.C.No.429 of 2000 on the file of the Court of the II Metropolitan Magistrate, Visakhapatnam, for the offences punishable under Sections 344, 346 and 324 of IPC, vide judgment dated 21.07.2003, the de-facto complainant filed the present appeal under Section 378(4) Cr.P.C.

There was no representation on behalf of the appellant on 08.02.2018. Even today also there is no representation on behalf of the appellant though the matter is listed under the caption 'for dismissal'. It seems that the appellant is not interested in prosecuting the appeal.

Hence the appeal is dismissed for non-prosecution. Miscellaneous petitions, if any pending in this appeal, shall stand closed.
