THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.294 of 2025 ORDER:
This Criminal Petition is filed by the petitioner/accused for grant of bail in connection with Crime No.843 of 2024 of Alwal Police Station, Cyberabad Commissionerate. The offence alleged against the petitioner is under Section 108 of the Bharatiya Nyaya Sanhita, 2023.

The case of the prosecution is that the brother of the deceased lodged a report before the police stating that on 29.10.2024 he received a phone call from the petitioner that his sister committed suicide. The marriage of the petitioner with his sister was performed in the year 2006 and they were blessed with two children. The petitioner used to harass the deceased and due to the harassment of petitioner, deceased committed suicide. As such, requested the police to take necessary action. Basing on the said complaint, the police registered the case for the said offence.

Heard Sri K. Karunakar, learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State. 4.
The contention of learned counsel for the petitioner is that petitioner is innocent of the alleged offence. As the deceased was suffering from some ill-health, she committed suicide. Petitioner was not present at the time of incident and the children went to school at that time. Further, the children and mother of petitioner are dependent on him. The petitioner is in jail from 19.12.2024 and material part of the investigation is completed. As such, prayed the Court to grant bail to the petitioner. 5.
On the other hand, the learned Additional Public Prosecutor opposed bail on the ground that investigation is not yet completed and prayed to dismiss this petition.

Considering the submissions made by both the counsel and the material on record, the petitioner is in jail from 19.12.2024 and 13 witnesses were already examined as on today. The petitioner herein is not present at the time of incident and the only allegation against the petitioner is that he abated the deceased for
- 3 - commission of suicide. Hence, this Court deems it fit to grant bail to the petitioner subject to the following conditions : i.
The petitioner shall execute a personal bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only), with two sureties for a like sum each to the satisfaction of the X-Additional Junior Civil Judge-Cum-X Additional Metropolitan Magistrate, Cyberabad at Medchal.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
