THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.23968 OF 2016 O R D E R :

This petition is filed for a writ of Mandamus declaring the action of the 2nd respondent in not stopping the registration in respect of RCC building bearing Municipal Door No.4-1-26, Opp.Head Post Office, Siricilla Town and Mandal, Karimnagar District, as illegal and arbitrary.

The case of the petitioner is that he entered into agreement of sale with the 3rd respondent in respect of the subject property by paying major part of sale consideration. But, the 3rd respondent had been postponing the registration of the subject property in favour of the petitioner on the ground that his mother and sister had filed a case against him and that he would execute a registered document soon after settlement with them. Meanwhile, the 3rd respondent is trying to alienate the subject property in favour of third parties violating the agreement of sale. Hence the petitioner filed the present writ petition.

Heard both sides.

It is purely civil litigation between the petitioner and the 3rd respondent and the petitioner has to agitate his rights in proper forum. Further, the disputed questions of fact cannot be decided in the writ petition.

In view of the above, the writ petition is dismissed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending

shall stand closed.
