THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY TRANSFER C.M.P.NO.727 OF 2015 O R D E R:

This Transfer C.M.P. is filed by the petitioner-wife against the respondent-husband for transfer of O.P.No.1145 of 2015 instituted by the respondent-husband for grant of divorce, pending on the file of Family Court Judge, City Civil Court at Hyderabad, to the file of Senior Civil Judge at Peddapalli, Karimnagar District.

The case of the petitioner is that her marriage with the respondent was solemnized on 12.12.2008 at Nandana Gardens, Peddapalli, Karimnagar District as per customs prevailing in their caste. After marriage, they lived happily for some time and were blessed with two children. Thereafter, the respondent started harassing the petitioner physically and mentally and filed O.P.No.201 of 2013 for restitution of conjugal rights and the same was dismissed by the Family Court Judge, City Civil Court, Hyderabad.

The respondent also filed O.P.No.1145 of 2015 under Section 13 (1) (ia) of Hindu Marriage Act, 1955 for divorce. It is also stated that the petitioner is working as Government Teacher and residing at

Peddapalli along with minor children and it will be very difficult for her to travel all the way from Peddapalli, Karimnagar to Hyderabad. Hence, the present Transfer C.M.P. is filed. Though notice is sent to the respondent, it was returned with an endorsement 'unclaimed'. Hence, it is deemed that notice is served.

The learned counsel for the petitioner submits that the petitioner is working as a Government Teacher at Peddapalli, Karimnagar District and having two minor children and it will be difficult for her to travel all the way from Karimnagar to Hyderabad.

In view of above facts and circumstances of the case, O.P.No.1145 of 2015 pending on the file of Judge, Family Court, City Civil Court at Hyderabad has to be transferred to the file of Senior Civil Judge at Peddapalli, Karimnagar District. The Transfer C.M.P. is accordingly allowed.

Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
