THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.23331 of 2010 ORDER:

This writ petition was filed challenging the action of respondents in interfering with civil disputes in respect of the petitioner's marble shop to an extent of 600 square yards out of Ac.1.85 cents in R.S. No.218/8 (full) of Vatluru Village and Gram Panchayat, Pedapadu Mandal, West Godavari District. A counter affidavit is filed by respondent No.3 stating as follows:

"As of now, no complaint whatsoever is received against the petitioner herein and in the absence of registration of any crime, the question of summoning him to the police station does not arise.

I submit that the respondent police never summoned the petitioner nor threatened him nor asked him to settle the matter with Mr. Desapati Rao. I submit that the dispute between the petitioner as well as the said Mr. Desapathi Rao is purely civil in nature and the respondent police has nothing to do with it. As a precautionary measure and to prevent the police from taking any action in future if any complaint lodges against him, the petitioner rushed to this Hon'ble Court and filed the writ petition with baseless allegations. I submit that either this respondent or the 2nd respondent never sent any constables to the petitioner herein and asked him to settle the matter with the said Desapathi Rao. I submit that though the petitioner made allegations against Mr.

Desapathi Rao, intentionally not made him as a proper party to this writ petition. All the allegations made against the respondent police are false, baseless and invented for the purpose of filing the writ petition. I humbly submit that the respondents herein are being strictly complied with the interim directions of this Hon'ble Court."

In view of the above and in the absence of any other material justifying the relief sought for in this writ petition, no relief can be granted in this writ petition.

Accordingly, this Writ Petition is dismissed. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
