Heard Mr.K.Rama Subba Rao, counsel for the petitioner. None appears for respondents.
The petitioner challenges Memo Rc.No.169/HGs/Estt.II/2006 dated 04.04.2006 of the 1st respondent and order in C.No.19/R1.HG/ADD/2006 (D.O.No.12/2006) dated 02.05.2006 of the 2nd respondent as illegal, voilative of principles of natures and unconstitutional.
This Court, on 19.06.2006 in W.P.M.P.No.15010 of 2006, passed the following order:
"It is submitted by the learned counsel for the petitioner that as per the rules framed in exercise of powers under the A.P.Home Guards Act, 1948, in all cases of disciplinary action, reasonable opportunity shall be given. It is further stated that in exceptional cases, by recording reasons, such a procedure can be bypassed.
However, on a reading of the impugned order there is no indication of giving any prior notice and no reasons have been recorded for waiver of notice. In that view of the matter, there shall be interim suspension as prayed for. Notice."
The respondents, it is submitted by counsel appearing for petitioner, have in obedience to the interim order dated 19.06.2006 reinstated the petitioner through order in C.No.18/RI.HG/ADD/2006 dated 19.07.2006 and is working with the respondent. In view of the above, the interim order dated 19.06.2006 is made final order in the writ petition.
The writ petition is, accordingly, disposed of. There shall be no
order as to costs.
Consequently, miscellaneous petitions, if any pending, also stand closed.
