HON'BLE SRI JUSTICE SURESH KUMAR KAIT CIVIL REVISION PETITON No.917 of 2010 ORDER :

The present petition was filed questioning the order dated 01.12.2009 in I.A.No.730 of 2009 in O.S.No.2287 of 2009 on the file of the VI Additional Junior Civil Judge (Fast Track Court), Visakhapatnam, whereunder, the petition filed by the petitioners/defendant Nos.2 and 3 under Section 10 r/w.151 CPC for stay of trial of the suit pending disposal of the earlier suit vide O.S.No.616 of 2002 (originally O.S.No.889 of 1979) and O.S.No.113 of 1986 both on the file of the III Additional Senior Civil Judge, Visakhapatnam, was dismissed.

The present petition was admitted by this Court on 30.04.2010.

The Registry of this Court obtained telephonic information from the concerned Court stating that the suit O.S.No.2287 of 2009 itself was dismissed for default on 16.11.2015.

In view of the facts recorded above, the present petition has become infructuous. Accordingly, the petition is dismissed as infructuous. No costs.

Pending miscellaneous applications, if any, shall stand closed.
