Heard learned counsel for the petitioners, who submits that the lis in this Writ Petition is squarely covered by orders of this Court in WP No.38452 of 2017, dated 28.11.2017. In view of the same, following the ratio laid down in the above referred judgment, this Writ Petition is partly allowed setting aside the declaration dated 02.12.2017. The petitioners are given liberty to file comprehensive written objections either individually or for the entire village in accordance with Section 15(2) of the Act 30 of 2013, within two weeks from the date of receipt of a copy of this order and the Collector shall consider the said objections and deal with said objections thoroughly and pass a reasoned order considering the objections raised by the petitioners within a period of four weeks thereafter.
It is needless to observe that at the time of considering the objections, the objectors shall be heard either in person or through their counsel. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. Let a copy of order in WP No.38452 of 2017, dated 28.11.2017 be annexed with this order.
