HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.23240 of 2017 ORDER:
Heard Mr. M Laxman Rao for petitioner and the learned Assistant Government Pleader (Revenue) for respondents.
2. The petitioner complains against threatened action of respondents 4 and 5 in interfering with petitioner's possession and enjoyment in an extent of Ac.2.02 guntas in Sy.No.335 at Tharamathipet Village, Abdhullahpurmet Mandal, Ranga Reddy District, as arbitrary and unconstitutional.
3. The Assistant Government Pleader (Revenue) for respondents, places on record the written instructions dated 15.07.2017 and the operative portion reads thus:
" ...Accordingly the MRI/ VRO has been enquired into the petition of Sri Chakali Sathaiah conducted panchanama. As reported by the MRI Sri Chakali Sathaiah is not in possession on the suit land Sy.No.335 extent Ac.1.29 gts., and found one Sri Vaddepally Papaiah petitioners herein is in physical possession and cultivated paddy crop with bore well water. The name of the petitioner Sri Vaddepally Papaiah & Sri Vaddepally Balaiah is recorded in revenue records to an extent of Ac.1.01 gts., each in Sy.No.335 of Taramathipet Village since 1999-2000 onwards in occupant column.
The Tahsildar, MRI or VRO have not never disturbed harassed or threatened to Sri Vaddepally Papaiah & other. They are enjoying the suit land to the extent Ac.2.02 gts and cultivating paddy crop.
These are the facts of the suit land of Sy.No.335 extent Ac.2.02 gts., of Taramathipet Village, Abdullapurmet Mandal."
4. Having regard to the written instructions, no further order is necessary. The writ petition is disposed of by placing on record the
written instructions dated 15.07.2017. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
