THE HON'BLE SRI JUSTICE T. VINOD KUMAR Writ Petition No.679 of 2020 ORDER:

The present writ petition is filed to declare the action of the respondents, more particularly 5th respondent herein in interfering with the possession and enjoyment of lands of the petitioner admeasuring Ac.1.00 guntas in Survey No.404/C and Ac.1.00 guntas in Survey No.405 situated at Aswaraopally Village, Raghunathapally Mandal, Jangaon District, as being illegal and arbitrary.

Heard Sri N. Rajeshwar Rao, learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for the respondents.

The learned Assistant Government Pleader for Home, on written instructions dated 10.01.2020, which is placed on the record of this Court submits that one R. Kiran gave a petition to the Sub-Inspector of Police, Raghunathapally on 08.12.2019 stating that on 07.12.2019, when they started work in their venture, a person came to disturb their land and on enquiry, it disclosed that the name of said person is Thallapally Yadaiah, as such requested to take necessary action. It is further stated that on receipt of above petition, GD entry was made and enquiry was done, during enquiry called both the parties and caused enquiry about the issue and after such enquiry, closed the petition as 'civil in nature'.

The learned Assistant Government Pleader for Home, on the basis of written instructions, further submits that except causing enquiry on the petition given by R. Kiran, the respondent police authorities never interfered in the civil issues of the petitioner at any point of time. By the said written instructions, the other averments made by the petitioner in the writ affidavit regarding the respondent police authorities continuously threatening the petitioner to vacate the land is denied.

Recording the above submissions made on behalf of the respondent authorities, no further orders need be passed in this writ petition.

Accordingly, the writ petition is closed. However, there shall be no order as to costs.

As a sequel thereto, Miscellaneous Applications, if any, pending in this Writ Petition shall stand closed. ___________________ T. VINOD KUMAR, J Date: 31.01.2020 Isn
