THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.348 OF 2024 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.1 & 2 in Crime.No.423 of 2023 on the file of Inthezargunj Police Station, Warangal District, registered for the offence under Section 8 (c) r/w. 20 (b) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of Inthezargunj Police is that they found these petitioners and two others on 26.09.2023 transporting ganja. These two petitioners and a minor boy were held. It is alleged that 8 kgs. of ganja was seized from each of these petitioners. 4.
Learned counsel appearing for the petitioners would submit that petitioners have nothing to do with one another and they have been falsely implicated. Further, the quantity of
contraband seized from these petitioners is less than the commercial quantity.

On instructions, learned Additional Public Prosecutor would submit that there are no questionable antecedents against these petitioners.

Keeping in view that the quantity of contraband seized from each of these petitioners is 8 kgs. and there being no other cases pending against them, this Court deems it appropriate to grant the relief of regular bail, subject to following conditions:- i) The petitioners/Accused Nos.1 & 2 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties i.e., one local surety and the other from the native place, for a like sum each to the satisfaction of the I Additional Judicial First Class Magistrate, Warangal, Warangal District. ii) The petitioners/Accused Nos.1 & 2 after release shall appear before concerned Station House Officer at 10:00 a.m. on every Monday for a period eight weeks for the purpose of investigation and thereafter, as and when required.
iii) The petitioners/Accused Nos.1 & 2 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
