S.Krishnaveni D/O Srinivasa Rao v. The State Of Andhra Pradesh

ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:

"To issue a writ, or order or orders or direction one in the nature of writ of Mandamus, seeking directing the respondents not to register the further crimes on the multiple complaints for same set of alleged commission of offence made in Crime No.68 of 2015 on the file of respondent No.3, in order to protect the rights of the petitioners under Articles 20 and 21 of the Constitution of India".

2. Heard Sri T.D.Phani Kumar, learned counsel for the petitioners and learned Government Pleader for Home, appearing for respondents, apart from perusing the material available on record.

3. The Inspector of Police, Araku Circle, Visakhapatnam district has filed a counter affidavit and to the extent of relevancy to present case, the averments in paragraph No.1 are extracted below: "When I (Respondent No.3) took up investigation in this case, so many victims in various places are approached along with their representations to Respondent No.3 and recorded their statements U/s 162 Cr.P.C. to strengthen in this case, but I (Respondent No.3) could not register another or more cases except in the above reference".

4. On noticing the said averments, the learned counsel for the petitioners requested this Court to dispose of the writ petition by recording the said averments.

5. For the foregoing reasons, the writ petition is disposed of, by recording the averments made in the counter affidavit. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
