THE HON'BLE SRI JUSTICE T. VINOD KUMAR Writ Petition No.673 of 2020 ORDER:

The present writ petition is filed to declare the action of the respondents 2 & 3 in allowing the respondent No.5 to forcibly and illegally occupy the petitioner's quarter bearing No.SRT-160 situated at Old Kannala Basti, Bellampalli area, as being illegal and arbitrary.

Heard Sri V. Raghunath, learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for the official respondents and Sri J.Sreenivasa Rao, learned Standing Counsel for 4th respondent-Singareni Collieries Company Ltd. The learned Standing Counsel for 4th respondent on written instructions dated 25.01.2020 submits that the petitioner herein was declared as unfit from service and on being declared as unfit for employment, the said quarter was allotted to one Masadi Ravinder, Badili Worker, Kasipet-2 incline, who is none other than the son of the petitioner. Having regard to the above stated, the case of the petitioner that he has forcibly evicted from SRT-160 at Old Kannala Basti, Bellampalli area is factually incorrect, more particularly, since the said quarter has been allotted to the petitioner's own son, the claim of the petitioner that the said quarter being occupied by the 5th respondent is unfounded.

In view of the above, the writ petition is without merit and is dismissed accordingly. However, there shall be no order as to costs.

As a sequel thereto, Miscellaneous Applications, if any, pending in this Writ Petition shall stand closed. ___________________ T. VINOD KUMAR, J Date: 31.01.2020 Isn
