THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.355 OF 2024 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.2 in Crime.No.51 of 2022 on the file of EOW Team VI, Central Crime Station (CCS), DD, Hyderabad, registered for the offences under Sections 406, 420, 468, 467 and 471 r/w. 120b, 34 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that A-1 is the father of A-2 and A-3. Father of A-1 executed will deed dated 17.12.2023 in favour of A-1 and the husband of L.W.1 by sharing the property bearing H.No.21-3-291, 21-3-292, Petlaburj, Hyderabad. After the death of husband of L.W.1, A-1 to A-3 entered into criminal conspiracy and hatched a plan to grab the share of property of L.W.1 and prepared forged and fabricated will deed dated 14.06.2023 in favour of A-2. Later A-2 executed gift deed dated 03.08.2017 in favour of A-3 and by colluding with each other,

they sold the said property to A-4 and A-5. By knowingly, A-4 and A-5 supported to A-1 to A-3 and purchased the said property. 4.

As seen from the facts of the case, it appears that there are property disputes among the family members and all the documents are in custody of the Investigating Agency. For the said reason, this Court is inclined to grant the relief of regular bail, subject to following conditions:- i) The petitioner/Accused No.2 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum each to the satisfaction of the XII Additional Chief Metropolitan Magistrate, Hyderabad.

ii) The petitioner/Accused No.2 after release shall appear before concerned Station House Officer at 10:00 a.m. on every Monday for a period four weeks for the purpose of investigation and thereafter, as and when required. iii) The petitioner/Accused No.2 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 5.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
