HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.252 OF 2020 ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure seeking quashing of the proceedings in C.C.No.599 of 2018 on the file of the Additional Judicial First Class Magistrate at Jangaon.

A charge sheet came to be filed against the petitioners/A-1 to A-4 for the offence punishable under Section 380 of the Indian Penal Code.

Though the present Criminal Petition is filed seeking quashing of entire proceedings, but learned counsel for the petitioners/A-1 to A-4 restricts his prayer seeking dispensation of the presence of the petitioners/A-1 to A-4 before the trial Court on every date of adjournment.

The learned Public Prosecutor submits that since the identity of petitioners/A-1 to A-4 is not in dispute, their presence in the above Sessions Case may not be necessary on every date of adjournment.

Having regard to the facts and circumstances of the case, the personal appearance of the petitioners/A-1 to A-4 in C.C.No.599 of 2018 on the file of the Additional Judicial First Class Magistrate at Jangaon, is hereby dispensed with except on the dates when their presence is specifically required by the Court.

With the above direction, the Criminal Petition is disposed of.

Miscellaneous applications, if any, pending shall stand closed.
