This application is filed to permit the petitioner to travel abroad by returning his passport for a limited period from JulyDecember 2023 by relaxing the bail conditions viz., deposit of passport and not to leave the Country, imposed vide order of this Court dated 07.02.2022, passed in Crl.P.No.237 of 2022.

The grievance of the petitioner is that previously as per the direction of this Court an application was moved before the Trial Court to release of passport and relax the condition not to leave the country. The said conditions were relaxed temporarily for a period of five months, but within that time the petitioner failed to travel abroad. Therefore, again he seeks temporary relaxation of those conditions as he need to travel abroad.

Heard learned counsel on either side and perused the material placed on record.

Considering the previous modification of conditions for temporarily, the request of the

petitioner can be allowed with certain conditions.

Resultantly, this Criminal Petition is allowed in part as follows:

(i) The Court below is directed to return the passport to the petitioner for a period six months from the date of its release subject to the condition of furnishing security of Rs.5,00,000/-.

(ii) The petitioner shall redeposit the pass port before the concerned Court below immediately after six months from the date of its release without any delay. If any delay is occurred Court below is entitled to forfeit the amount paid as security.

(iii) The petitioner shall also furnish the details of travel to the Court below.

(iv) Condition to not leave the Country also partly relaxed for the said period of six months.
