THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.24135 OF 2017 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the inaction on the part of respondent Nos.1 to 5 on the petitioner's representation dt.23.01.2017 submitted to remove the encroachments being undertaken by respondents 6 and 7 in lands admeasuring Ac.0.93 1⁄2 cents in Survey No.1431 and Ac.4.40 cents in Survey No.786/6 situated in Padarthi Village in Kothapatnam Mandal of Prakasam District belonged to the 5th respondent temple and also to take steps to file O.A against the respondents 6 and 7, who alienated the endowment lands as illegal, irregular, irrational, contrary to the provisions of Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987 and rules framed there under and offends Articles 25 and 26 of Constitution of India and consequently direct the respondents 1 to 5 to evict the encroachers from the said lands."

After arguing for sometime, learned counsel for the petitioner requested the Court to direct respondent Nos.1 to 5 to consider the representation, dated 23.01.2017, of the petitioner and take action against respondent Nos.6 and 7 in accordance with law. 3.
Considering the facts and circumstances of the case and the grievance of the petitioner, without going into the merits of the case, respondent Nos.1 to 5 are hereby directed to consider the representation, dated 23.01.2017, of the petitioner and take
appropriate action in accordance with law regarding the encroachment alleged to have been made by respondent Nos.6 and 7, as expeditiously as possible.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
