THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 9257 of 2015 ORDER:
The petitioners challenge the order dated 28.02.2015 passed by the 2nd respondentJoint Collector in I.A.No.18/2014 in ROR Revision Petition No.32/2014, whereby the orders dated 28.02.2014 passed by the 3rd respondent-Revenue Divisional Officer in ROR Case No.A3/3834/2010, were stayed until further orders.
2. Learned counsel for the petitioners submits that the revision itself came to be filed by third parties who are not parties before the Revenue Divisional Officer in the ROR Appeal. However, on behalf of the petitioners, a request was made for adjournment before the revisional authority seeking time for engaging an advocate and bringing to the notice of the revisional authority that the 1st respondent therein died in the year 2014 and the legal heirs are required to be added. Inspite of the same, the revisional authority granted stay. Hence, the writ petition.
3. A perusal of the order dated 28.02.2015 passed by the 2nd respondent/revisional authority would reveal that the order, by itself, does not express any opinion on the merits of the matter and the same has been passed staying the orders of the Revenue Divisional Officer; thereby meaning that the order is not an absolute one and the parties are to be heard and final orders are to be passed. In fact, the main revision was also directed to be listed for hearing on 02.04.2015 i.e. today.

In view of the submission of the petitioners' counsel that the petitioners have already put up their appearance before the revisional authority, interest of justice would be served if a direction is issued to the 2nd respondent-Joint Collector to dispose of the revision itself, for which the 2nd respondent himself had fixed the date as 02.04.2015, as expeditiously as possible, preferably within a period of three months from today.
5. Accordingly, the writ petition is disposed of. No costs. Miscellaneous Petitions, if any pending in this writ petition, shall stand closed.
