HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.42753 of 2016 O R D E R :
The Writ Petition is filed under Article 226 of the Constitution of India seeking to issue a writ or order, more particularly one in the nature of writ of Mandamus declaring the proceedings in D.V.C. No.15 of 2016 on the file of the Court of Judicial I Class Magistrate, Thorrur, Mahabubabad, Warangal District, as illegal and arbitrary and consequently, quash the same.
Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Home and perused the material available on record.
After arguing for sometime, the learned counsel for the petitioners, while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioners before the trial Court.
In any event, considering the nature of allegations against the petitioners, presence of the petitioners before the trial Court is dispensed with except on the dates of framing of charges, examination under Section 313 Cr.P.C. and pronouncement of the judgment. However, the petitioners shall be properly represented through their counsel before the trial Court.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
Consequently, miscellaneous petitions pending, if any, in the writ petition shall stand closed.
