THE HON'BLE SRI JUSTICE R. SUBHASH REDDY AND THE HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.36599 OF 2014 ORDER: (Per Hon'ble Sri Justice R. Subhash Reddy) This Writ Petition is filed seeking to refund the amount of Rs.14,32,212/-, which is collected under the provisions of the Andhra Pradesh Value Added Tax Act, 2005, together with interest.

During the course of hearing, learned Government Pleader for Commercial Taxes has produced a copy of the reasoned order, dated 25.02.2015, passed in AAO No.5569 by the Commercial Tax Officer, Gandhinagar Circle, Secunderabad Division, rejecting the refund claimed by the petitioner.

Though the learned counsel for petitioner has argued that the reasons given in the order, dated 25.02.2015, are not relevant at all, the same cannot be gone into in this Writ Petition.

In view of the order, dated 25.02.2015, learned counsel for the petitioner seeks permission for withdrawal of the Writ Petition with liberty to question the aforesaid order.

Permission is granted and the Writ Petition is dismissed as withdrawn with liberty to the petitioner to question the order, dated 25.02.2015, if he is aggrieved. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. No costs.
